1. AGREEMENT TO TERMS

These Terms and Conditions of Use ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Whim Fine Jewelry LLC ("Company," "we," "us," or "our"), concerning your access to and use of the Whim Fine Jewelry website (the "Site"). By accessing the Site and purchasing our products, you agree to be bound by these Terms. If you do not agree with these Terms, you must discontinue use of our Site immediately.

2. MADE-TO-ORDER PRODUCTS & ALL SALES FINAL

All our jewelry is handmade to order. Because of this, all sales are final after 76 hours from the time of purchase. We do not accept cancellations or returns beyond this window. Please ensure all details, including ring size, metal type, and stone selection, are correct before completing your purchase.

3. SHIPPING & RISK OF LOSS

We take great care in shipping our products, but once an order is shipped, we are not responsible for lost, stolen, or damaged packages. Risk of loss transfers to you upon delivery to the carrier. If your package includes insurance, you may file a claim directly with the carrier. We are happy to help facilitate this process where possible.

No changes can be made to shipping information once an order has been shipped. Any additional shipping costs due to incorrect addresses provided by the customer are the customer’s responsibility.

4. CUSTOM ORDERS & DESIGN RIGHTS

All custom designs, sketches, and CAD renderings are the intellectual property of Whim Fine Jewelry LLC. While custom designs are created in collaboration with you, the final design remains the property of Whim Fine Jewelry and may be adapted or reproduced unless otherwise agreed upon in writing.

5. PRODUCT VARIATIONS & HANDMADE NATURE

Due to the handmade nature of our products and the unique qualities of natural gemstones and diamonds, slight variations in color, texture, and finish may occur. These variations are not considered defects but part of the artisanal quality of our jewelry.

6. SIZING & RESIZING

It is the customer’s responsibility to provide accurate sizing. While we offer guidance on ring sizing, Whim Fine Jewelry is not liable for incorrect size selection. Resizing may incur additional fees and may not be possible for all styles.

7. REPAIRS & WARRANTY

We stand behind the quality of our craftsmanship. Whim Fine Jewelry offers complimentary repairs for manufacturing defects within 60 days of delivery. This does not cover damage from misuse, wear and tear, or loss/theft. For repair inquiries, please email laura@whim.nyc with photos and order details.

8. INTERNATIONAL ORDERS & DUTIES

For international customers, all duties, customs, and taxes are the responsibility of the recipient. Whim Fine Jewelry LLC is not responsible for delays or fees incurred through international customs processes.

9. INTELLECTUAL PROPERTY RIGHTS

All content on this Site, including but not limited to text, images, logos, graphics, designs, and product descriptions, is the exclusive property of Whim Fine Jewelry LLC and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or use any content from this Site without our express written permission. Unauthorized use may result in legal action.

10. DISCLAIMERS & LIMITATION OF LIABILITY

We make no warranties as to our products, services, or website content. You agree that our products, services, and website are provided “as is” and without warranties of any kind, either express or implied. To the fullest extent permissible pursuant to applicable law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the Site will be uninterrupted, error-free, or free of harmful components. By using this Site, you acknowledge and agree that Whim Fine Jewelry LLC shall not be held liable for any direct, indirect, incidental, special, or consequential damages arising from the use of our products, services, or website content.
